These Terms of Service ("Terms") govern your access to and use of the Ignite Lean website and software platform (the "Service") provided by Ignite Lean LLC ("Ignite Lean", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of a company, you represent that you are authorized to bind that company to these Terms.
Ignite Lean provides a manufacturing execution and quality platform, including production execution, quality management, and maintenance features. We may update, improve, or change the Service over time.
You must provide accurate information when you create an account, keep your credentials secure, and are responsible for all activity under your account. Notify us promptly of any unauthorized use. You are responsible for your users and for ensuring they comply with these Terms.
You retain all rights to the data you and your users submit to the Service ("Customer Data"). You grant us a limited license to host, process, and display Customer Data solely to provide and improve the Service and as directed by you. You are responsible for the accuracy and legality of Customer Data and for having the rights needed to submit it.
You agree not to misuse the Service. You will not use the Service to violate any law; infringe the rights of others; upload malicious code; attempt to gain unauthorized access; interfere with or disrupt the Service; or reverse engineer, copy, or resell the Service except as permitted by law.
The Service offers a free plan and paid plans. Paid plans are billed per manager seat as described on our pricing page. Operators and viewers are included at no charge. Fees are stated exclusive of taxes, which you are responsible for. We may change pricing on a going-forward basis with notice. Except where required by law, fees are non-refundable.
We may offer a free plan with limited seats. We may change or discontinue the free plan at any time. We may also suspend or limit accounts that abuse the free plan.
The Service, including its software, design, and content, is owned by Ignite Lean and protected by intellectual property laws. These Terms do not grant you any rights in the Service other than the limited right to use it. If you send us feedback or suggestions, you grant us a right to use them without restriction or obligation to you.
The Service may integrate with or rely on third-party services. We are not responsible for third-party services, and your use of them may be subject to their own terms.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error free, or secure.
To the maximum extent permitted by law, Ignite Lean will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the event giving rise to the claim.
You agree to indemnify and hold harmless Ignite Lean from any claims, losses, and expenses arising out of your use of the Service, your Customer Data, or your violation of these Terms.
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service. On termination, your right to use the Service ends. We will make Customer Data available for export for a reasonable period after termination, after which we may delete it.
These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Missouri, unless applicable law requires otherwise.
We may update these Terms from time to time. We will post the updated version with a new "Last updated" date, and significant changes will be communicated through the Service or by email. Continued use of the Service after changes take effect means you accept the updated Terms.
